Terms of Service

1. Eligibility and accounts

You must be able to form a binding contract under Indian law to use the service. You are responsible for your account, the accuracy of the information you provide, and all activity under your credentials.

2. The service

SocialHype is a marketing platform unifying social, CRM, funnels, email, SEO, and ads. Features and limits depend on your plan and may evolve over time.

3. Acceptable use

You agree not to misuse the service — including unlawful activity, sending spam, infringing others' rights, violating WhatsApp Business or any connected platform's policies, or attempting to disrupt or gain unauthorised access to our systems.

4. Subscriptions and billing

Paid plans (and any free trials) renew and are billed as described at sign-up, through our payment provider, Razorpay. Fees are stated in Indian Rupees and are inclusive or exclusive of GST as marked at checkout. Refunds are governed by our separate Refund & Cancellation policy.

5. Intellectual property

The service, including its software, design, and our own content, is owned by us or our licensors. Nothing in these terms transfers our intellectual property to you beyond the right to use the service under your plan.

6. Your content and ownership

You own the content you create, upload, or import into your workspace — your posts, media, contacts, campaigns, and customer data remain yours. You grant us only the limited rights needed to host, process, back up, and display that content so we can operate the service for you, and to provide AI features you choose to use. We do not claim ownership of your content and we do not sell it.

7. Third-party platforms and your responsibilities

The platform integrates with third-party services (such as social networks, messaging providers, and ad platforms). When you connect and use those services through SocialHype, you must comply with their policies as well as ours — including the Meta Platform Terms and policies, Google API Services policies, the LinkedIn API terms, and the WhatsApp Business Messaging and Commerce policies. Your use of each connected service is also subject to that provider’s own terms, and the provider may restrict or suspend your connected account for breaching its rules.

8. API and integration usage

Connections are made via OAuth using the minimum scopes a feature needs, and you can revoke access at any time. You are responsible for keeping your connected accounts in good standing, for the messages and content you send through them, and for any usage limits or charges those platforms apply (for example, WhatsApp conversation pricing). You must not use our APIs or integrations to scrape, overload, resell, or circumvent platform rules.

9. Disclaimers

The service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, Social Hype Technologies Pvt Ltd is not liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our aggregate liability for any claim is capped at the amount you paid us in the twelve months preceding the claim. [Confirm liability cap with counsel.]

11. Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms or to protect the service.

12. Governing law

These terms are governed by the laws of India. Subject to mandatory consumer-law protections, any disputes are subject to the exclusive jurisdiction of the competent courts at Nashik, Maharashtra, India.
